Bankruptcy Doesn't Have to Mean No Car.

A bankruptcy is sometimes how a hard stretch ends, and it doesn't have to keep you from your next car. Mostly it changes the paperwork, which our Auburn finance team can help you sort out.

Not legal advice, just general information. Your attorney or trustee is the one to ask about your case.

The Western District's Chapter 13 vehicle request

Federal law divides Washington into an Eastern and a Western bankruptcy district, with King County assigned to the Western (28 U.S.C. 128). After confirmation of a Chapter 13 plan, you have a direct route under Local Bankruptcy Rule 3015-2: a letter asking the trustee to approve vehicle financing.

A yes from the trustee means you don't need a court order as well. A no can still be heard by the court on a motion, which your attorney files. Lenders tend to want that approval in hand before funding, so get the request moving well before you pick out a vehicle.

Five ways to prepare

Your attorney's advice comes first. These just help a lender understand where you are now.

  1. Pull together your court papersThat's the discharge order if your case is closed, or written permission for the new debt if your Chapter 13 is still open. Lost the discharge order? Your attorney can get you a copy.
  2. Check your reportsGet all three free at AnnualCreditReport.com and make sure each account included in the bankruptcy is listed the right way. Federal law allows a bankruptcy to appear for up to a decade after the case was filed (15 U.S.C. 1681c).
  3. Count all your incomeInclude benefits, unemployment compensation, a pension, part-time pay and self-employment. Under Regulation B, income from part-time work, a pension or public assistance can't be discounted for the source; the lender sets how much counts.
  4. Shrink the loanCash down, a trade-in or a lower-priced vehicle all reduce what you finance. With a Chapter 13 open, the trustee will check that the payment won't threaten the plan.
  5. Shop for the loan in one stretchIf several auto lenders pull your credit within 14 to 45 days, scoring generally counts it once (CFPB). Wait to apply until you're ready to buy.

How lenders look at a past bankruptcy

A bankruptcy is one fact among many. The CFPB lists what else lenders weigh: income, debts, how much you borrow and for how long, your down payment measured against the vehicle's value, and the type of vehicle.

No single waiting period follows a discharge, since each lender writes its own rules. Our finance team learns about your case first, so your application only goes to lenders that will look at applicants with a bankruptcy. Approval isn't guaranteed.

Terms you'll see in your case

TermIn short
DischargeThe court's order wiping out your personal obligation on most debts you listed (U.S. Courts); lenders generally want a copy.
Chapter 7A case that discharges most debts, often a few months after filing.
Chapter 13A three to five year repayment plan that lets you keep your property (U.S. Courts).
Trustee approvalThe trustee's written permission for new debt during a Chapter 13. Lenders usually want it before they fund.
Reaffirmation agreementYour agreement to stay liable for a debt, such as the loan on a car you want to keep, even though Chapter 7 would otherwise end it. Make that choice with your attorney.

Frequently asked questions

How long do I have to wait to buy a car after Chapter 7?

There's no fixed wait. You can apply as soon as the discharge is entered, with the order in hand, and each lender then applies its own rules on timing.

Is it OK to finance a car before my Chapter 7 discharge?

That's a question for your bankruptcy attorney before you sign anything. Expect lenders to ask for the discharge order, too.

Is buying a car during Chapter 13 allowed?

It can be, with approval. U.S. Courts advises talking to the trustee before taking on debt, and in the Western District a confirmed plan lets you write to the trustee asking to finance a vehicle. If the trustee says no, your attorney can bring a motion.

Does bankruptcy affect getting a car loan?

It's part of what a lender sees, for up to 10 years from the filing, and each lender decides how much it matters next to your income, debts, down payment and the vehicle.

Will Bud Clary Auburn Volkswagen work with me after a bankruptcy?

Yes. Our finance team accepts applications from buyers with a closed Chapter 7 or a Chapter 13 underway, and sends them to lenders that consider bankruptcy on a report. The lender decides; no approval is guaranteed.

What does reaffirming a car loan mean?

It means signing on to keep owing a car loan the Chapter 7 discharge would otherwise end, usually so the car stays with you. Because it carries real consequences, talk it over with your bankruptcy attorney first.

Does Fresh Start have anything to do with my bankruptcy case?

No. "Fresh start" is a phrase bankruptcy law uses, but Fresh Start Finance Program is just Bud Clary Auburn Volkswagen's name for how our finance team works with credit-challenged buyers. Your case and your attorney's advice are separate from it.
